Welcome to Mumconomy (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of our website and services (the “Platform”). By accessing or using Mumconomy, you agree to be bound by these Terms.


1. Overview of the Platform

Mumconomy is an online marketplace that connects individuals (“Users”) who offer services, tasks, or digital products (“Sellers”) with those seeking to purchase them (“Buyers”). We are not a party to any agreements between Buyers and Sellers.


2. Eligibility

You must be at least 18 years old to use this Platform. By using Mumconomy, you confirm that you have the legal capacity to enter into a binding agreement.


3. User Accounts

  • You are responsible for maintaining the confidentiality of your account details.
  • You agree to provide accurate and up-to-date information.
  • You are responsible for all activity under your account.
  • You must provide a NZ phone number and region so that we can authenticate your account.

We reserve the right to suspend or terminate accounts that violate these Terms.


4. Seller Responsibilities

Sellers agree to:

  • Provide accurate descriptions of their services or products.
  • Deliver services as described and within agreed timeframes.
  • Communicate respectfully with Buyers.
  • Comply with all applicable laws and regulations.

Sellers are solely responsible for the services they provide.


5. Buyer Responsibilities

Buyers agree to:

  • Provide clear instructions and necessary information.
  • Make payments promptly.
  • Communicate respectfully with Sellers.
  • Do due diligence to review the seller’s legitimacy prior to sending any money.

6. Tax Obligations (New Zealand)

Users are solely responsible for understanding and meeting their own tax obligations in relation to income earned through the Platform.

By using Mumconomy as a Seller, you acknowledge and agree that:

  • You are responsible for reporting all income earned through the Platform to the Inland Revenue Department (IRD).
  • You may be considered self-employed or operating as a sole trader, and must comply with all applicable New Zealand tax laws.
  • You are responsible for filing your own tax returns, including income tax and any other applicable taxes.
  • If your earnings meet the relevant threshold, you may be required to register for and account for Goods and Services Tax (GST).
  • You are responsible for any ACC levies, provisional tax, or other obligations associated with self-employment.

Mumconomy does not provide tax advice and is not responsible for any tax obligations of Users.

Users are responsible for seeking independent financial or tax advice where required.

7. Payments and Fees

  • All payments must be made through the Platform or an approved third-party provider.
  • Mumconomy may charge service fees or commissions, which will be disclosed before purchase.
  • Users agree not to circumvent the Platform to avoid fees.
  • Sellers are responsible for setting their pricing and ensuring it is accurate.

Mumconomy does not act as a bank, escrow service, or financial intermediary unless explicitly stated.


8. Refunds, Cancellations, and Disputes

  • Refund and cancellation policies may vary by Seller and must be clearly stated in each listing.
  • Buyers should review all listing details before purchasing.
  • In the event of a dispute, Users agree to first attempt to resolve the issue directly with each other.
  • Mumconomy may, at its discretion, assist in resolving disputes but is not obligated to do so.
  • We reserve the right to make final decisions on disputes where Platform policies have been breached.

9. Consumer Law (New Zealand)

Nothing in these Terms is intended to limit or exclude any rights you may have under the entity [“legislation”,”Consumer Guarantees Act 1993″,”New Zealand statute”] or the entity [“legislation”,”Fair Trading Act 1986″,”New Zealand statute”].

Where services are supplied in trade, Consumers may have rights relating to:

  • Services being carried out with reasonable care and skill
  • Services being fit for purpose
  • Remedies where services are not delivered as agreed

Sellers are responsible for complying with all applicable consumer protection laws.


10. Safety

  • Users are not recommended for their own safety to provide in-person services. Mumconomy is an online service platform.
  • Sellers must ensure they are qualified, experienced, and legally permitted to provide any services they offer.
  • Appropriate care must be taken where services involve children or vulnerable persons.
  • Mumconomy does not conduct background checks or verify qualifications unless explicitly stated.
  • We reserve the right to review listings and user accounts before approval, but we do not guarantee that all content will be reviewed.

Users agree to exercise caution and good judgment when interacting with others on the Platform.


11. Prohibited Conduct

Users must not:

  • Use the Platform for illegal activities.
  • Post false, misleading, or harmful content.
  • Harass or abuse other users.
  • Attempt to circumvent Platform fees or processes.

9. Intellectual Property

All content on the Platform (excluding user-generated content) is owned by Mumconomy. You may not reproduce or distribute it without permission.

Users grant us a non-exclusive license to use content they upload for Platform operation and promotion.


10. Limitation of Liability

To the maximum extent permitted by law, Mumconomy is not liable for:

  • Any indirect, incidental, or consequential damages.
  • Disputes between Buyers and Sellers.
  • Loss of income, data, or reputation.

11. Disclaimer

The Platform is provided “as is” without warranties of any kind. We do not guarantee the quality, safety, or legality of services offered.


12. Termination

We may suspend or terminate your access at any time if you breach these Terms.


13. Governing Law

These Terms are governed by the laws of New Zealand.


14. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform constitutes acceptance of the updated Terms.
